4. Warranties And Liability
Provided always that:
• The Goods are handled, assembled, installed, used, maintained, and inspected in accordance with the Seller's operating and installation instructions or other notices or written advices issued in respect of the Goods;
• The Seller is provided with reasonable facilities for inspection and testing of the Goods; and
• If the Goods are suspected to be defective, the defect complained of must be reported to the Seller in writing within 7 days of the alleged defect becoming apparent and prior to the expiration of the 12-month Defects Liability Period;
Then, in respect of any defective Goods or parts manufactured or supplied by the Seller established to the Seller's reasonable satisfaction to have been defective at dispatch solely from faulty design, materials, or workmanship, the Seller will at its discretion either:
• Repair the Goods;
• Replace the Goods; or
• Provide a cash credit or voucher equivalent to the average residual value of the Goods as of the date of notification.
The Seller's warranty does not extend to Goods not of the Seller's direct manufacture, but the Seller will endeavor to pass along any manufacturer warranty to the Purchaser.
In the event that the Goods are not handled, installed, or maintained strictly in accordance with the Seller's operating instructions, the Seller shall have no liability whatsoever for any defect or consequential damage.
In no event shall the Seller be liable for:
• Any indirect, incidental, or consequential damages;
• Any loss of profits, business revenue, goodwill, or anticipated savings;
• Costs associated with mitigating or rectifying site environmental conditions, water supply issues, or property damage.
The total liability of the Seller for all losses caused by any breach or claim shall be strictly limited to 1 times the purchase price of the defective product or service directly linked to the claim.
